|Minnesota Antenuptial, Postnuptial and Co-Habitation AgreementsSometimes, when a couple decides to marry, the parties wish to draft an agreement that will protect their assets in the event that the marriage does not work out. Antenuptial agreements (commonly referred to as prenuptial agreements) are written contracts entered into by two people prior to getting married. An antenuptial agreement sets forth each person’s rights to income and property and responsibility for debts, in the event of death or divorce.

Antenuptial agreements are not just for the “rich and famous.” An antenuptial agreement is often appropriate and useful in a wide range of economic and social circumstances. Oftentimes, antenuptial agreements are useful tools in the event of a second or subsequent marriage, when either or both parties have children from prior relationships and want to protect distributions or inheritances to their children, in the event of death or divorce.
Postnuptial agreements are similar in purpose to an antenuptial agreement, but are entered into by spouses who are already legally married. A postnuptial contract is valid and enforceable only if at the time of its execution, each spouse is represented by separate legal counsel.
Cohabitation agreements are used for the same purpose, by persons who either do not intend to or cannot legally get married.
Whether you are already married, considering marriage or involved in a significant relationship without intent to marry, if you have concerns regarding protection of your assets and/or providing for your children’s future, contact an attorney at Appelhof, Pfeifer and Hart, P.A., to discuss whether or not you could benefit from entering into an antenuptial, postnuptial or cohabitation agreement.
