What is domestic abuse?

Abuse takes many forms and can have long-lasting effects on family members, in addition to the immediate disruption of daily life. In Minnesota, “a domestic violence-related offense” is defined as any of the following, if committed against a family or household member:

  • Murder
  • Assault
  • Domestic assault
  • Domestic assault by strangulation
  • Criminal sexual conduct
  • Malicious punishment of a child
  • Terroristic threats
  • Violation of domestic abuse Order for Protection
  • Violation of domestic abuse no-contact order
  • Violation of harassment restraining order
  • Harassment or stalking
  • Interference with an emergency call
  • A violation of similar laws of any other U.S. jurisdiction

For purposes of the domestic violence laws, a family or household member includes:

  • Spouses
  • Former spouses
  • Parents
  • Children
  • Other blood relatives
  • Persons residing together or who have resided together in the past
  • Persons who have a child in common (or a child on the way)
  • Persons involved in a romantic or sexual relationship

Under Minnesota law, anyone who is the victim of domestic abuse may petition a court for an Order for Protection. An Order for Protection orders the abuser to stop harming or threatening you and your children. When an Order for Protection has been issued, the abuser must stay away from your home, workplace, school or other locations frequented by you and your minor children.
